Terms of Service

These terms govern your use of www.smartwebmakers.com and any services you engage SmartWebMakers to provide. By using this site or engaging our services, you agree to these terms.
1. Our Services
SmartWebMakers designs and builds websites for small businesses. Our static website packages start at ₹3,999 (Basic) and ₹6,999 (Enhanced), described in full on our Pricing page. Dynamic websites and custom development are quoted individually based on scope.
2. Pricing & Payment
Static website pricing is as published on our Pricing page and won't change without notice on this site. Year 1 pricing (₹3,999 Basic or ₹6,999 Enhanced) covers the build plus domain, hosting, and SSL for the first year. For any engagement, an advance payment is due before work begins, with the balance due upon your approval of the final design - the exact split is confirmed with you in writing before work starts. Dynamic and custom work is quoted and invoiced separately in writing before any work starts.
From Year 2, an annual renewal (₹2,799 Basic or ₹4,999 Enhanced) covers domain, hosting, and SSL renewal, plus a yearly change allowance described in full on our Pricing page. If a domain registrar or hosting provider changes their pricing, SmartWebMakers reserves the right to revise these renewal amounts accordingly. Any such change will be communicated to you before your next renewal - it will never be applied retroactively or without notice.
3. Cancellations & Refunds
Your advance payment is non-refundable once paid. It reserves your build slot and reflects time we turn away other work to prioritize yours - this applies whether you cancel before we start, partway through the build, or after seeing the preview and deciding not to proceed.
The one exception: if we fail to deliver a working preview within your agreed timeline plus a 5 business day grace period, and you provided complete content on time, you're entitled to a full refund of your advance.
If you cancel after work has started, no design files or source material are transferred to you - ownership only passes on full payment, as described in Section 5. If a domain was already registered on your behalf before you cancel, that specific registrar cost is not refundable, since it's a real cost already paid to a third party on your behalf.
Annual renewal payments (domain, hosting, SSL) follow the same rule - non-refundable once paid, since they cover a full year of third-party costs committed on your behalf at the time of payment.
4. Change Requests
The first 3 months after delivery include free change requests each month (2 on Basic, 3 on Enhanced), covering text and image updates only. New pages, sections, or functionality are quoted separately. From month 4 through the end of Year 1, changes are pay-per-change (₹500 each). From your Year 2 renewal onward, a yearly change allowance is included in the renewal fee (up to 2/year on Basic, 5/year on Enhanced) - anything beyond that allowance is ₹500 per change. 5. Ownership
Ownership of your website design and content transfers to you upon full payment. Until full payment is received, all work remains the property of SmartWebMakers. You're responsible for ensuring you have the rights to any logo, images, or content you provide us to use on your site.
This applies to static websites. Dynamic solutions built on our shared platform (such as PadhaiTrack) work differently: you own and have full use of your data and everything the solution does for your business, but the underlying platform code is not transferred, even after full payment. These solutions run on shared, custom-built infrastructure serving multiple clients - transferring that code would compromise security for every other client on it, not just you.
Owning your site's design and content is separate from keeping it live online. Domain registration and hosting are ongoing services included in Year 1 and renewed annually thereafter - if a renewal isn't paid, your domain and hosting will lapse and your site will go offline, even though you own the underlying design and content.
6. Your Responsibilities
You agree to provide accurate information and timely content (text, images, logo, and preferences) needed to complete your project. Delays in providing content will extend your delivery timeline accordingly.
7. Limitation of Liability
We aim to deliver reliable, well-built websites, but we can't guarantee uninterrupted uptime, third-party hosting performance, or specific business outcomes (such as traffic or sales) resulting from your website. To the extent permitted by law, SmartWebMakers isn't liable for indirect, incidental, or consequential damages arising from use of our services or this website.
8. Use of This Website
Content on this site, including our portfolio demo sites, is illustrative and intended to showcase our work - demo sites are clearly marked and do not represent real businesses. You may not scrape, copy, or misuse content from this site without our permission.
9. Governing Law
These terms are governed by the laws of India.
10. Changes to These Terms
We may update these terms from time to time. Continued use of this site after changes are posted means you accept the updated terms.
